British Embassy Beijing no longer accepts faxes
Please note that from Tuesday 20th July 2010 the British Embassy Beijing no longer accepts any faxes. If you have an enquiry, you should contact the Visa Application Centre by telephone. If you are calling from inside China, please telephone 400 821 1182. If you are calling from outside China, please telephone on 0086 21 28939105. They have English, Cantonese and Mandarin speakers and the service operates Monday to Friday from 08:00 hours to 17:00 hours (local time in China).

UK Government will introduce a limit on non- European immigration
The number of workers entering the UK from outside Europe will be controlled by a new limit, the UK Home Secretary, Theresa May, announced today. Details of how the final limit will be delivered will be agreed following a 12-week consultation with businesses and other interested parties. In the meantime an interim limit will be introduced to ensure there is no rush of visa applications being submitted and the number of work visas issued stays below levels from 2009. Customers who have lost their Biometric Residence Permit (BRP) (formerly known as Identity Card for Foreign Nationals (ICFN))
If you have lost your Biometric Residence Permit (BRP), we are unable to issue you a visa to enter the UK, or a letter to facilitate travel. You should get in touch with the UKBA Contact Centre on +44 (0) 20 8527 3623 to report that your BRP has been lost or stolen. You will be asked to provide contact details which will be forwarded to the Biometric Immigration Document Management Unit (BIDMU). They will, in turn, contact you by email. You can elect to attend an interview with a UKBA representative at the one of the following visa sections: Beijing, Guangzhou or Shanghai. Providing you satisfy the UKBA representative at interview that you are the rightful holder of the lost card and that you are genuinely studying in the United Kingdom, you will be given a temporary, replacement BRP. You must travel to the UK within 14 days of receipt of the new BRP.
You should not book any flights until you have received your new BRP.
You must surrender your temporary card to the UKBA Home Office within 21 days of your return to the UK and re-apply for a permanent card.

New visa customer service standards
From 1 April 2010 the UK Border Agency changed the customer service standards for processing visa applications. The changes are to complete 90 per cent of visa applications (except settlement categories), in not more than 3 weeks, 98 per cent in 6 weeks, and 100 per cent in 12 weeks. Each month we publish the actual turn around times for visa application by post and by category for the previous month, this is available at: http://www.ukvisas.gov.uk/en/howtoapply/processingtimes.
There are also new standards for biometric appointments and processing appeals that have been allowed by an immigration judge. Please see the UK Border Agency website for more information about the customer service standards.
We cannot guarantee that an application may be processed within the guidelines given above, as all visa applications are assessed individually which may result in varied processing times. Please be advised that during our busy summer season from May - October, we receive an extremely high volume of applications and as such, all visa applications take longer to process than usual. We continue to urge applicants to submit visa applications as early as possible to ensure the best chance of meeting their intended departure date. We strongly recommend that travellers do not purchase tickets or commit to other travel costs before the visa application has been processed, as there continues to be a risk that your visa application may be delayed or possibly refused. We do not accept responsibility for any financial loss and we do not fast-track applications solely due to planned date of travel.

Changes to student visa applications from February 2010
From 22 February 2010 all students who apply to study in the UK under Tier 4 of the points-based system must possess a Confirmation of Acceptance for Studies (CAS) from their sponsor. You will not be able to apply under Tier 4 using a visa letter from that date, even if the visa letter was issued before 22 February 2010. Until 21 February 2010, you can continue to apply under Tier 4 using a visa letter, even if your course of study will start after 22 February 2010. Please see the UK Border Agency

Pearson Test of English Academic
The Pearson Test of English Academic (PTE Academic) is an approved test for the purpose of scoring points for English Language under the Points-Based System. Unlike other tests, the PTE Academic does not produce a physical paper certificate on successful completion of the course. Results are provided to test takers through an online service with a printable confirmation document. As part of this service individuals are able to make their results/certificate available to selected institutions including the UK Border Agency.
Where an applicant is claiming points on the basis of a PTE Academic qualification we will accept the PDF results print out as proof of this, providing that we are able to verify its authenticity with Pearsons. The applicant must submit a printed copy of their score report with their visa application. If this has not been provided no points will be awarded for English Language.

The Points Based System means that only genuine students attending registered colleges can come to the UK to study. We continually check and monitor all student applications and colleges to ensure that they meet the required standards set by the Points Based System. As a result of this routine monitoring we have temporarily stopped taking new applications to study long term English language Courses and A levels or NVQ Level 3 or below at the Visa Application Centres (VACs) in Fuzhou, Guangzhou and Shenzhen. English language courses for 6 months and over are considered 'long term'. Those applying for English language courses of less than 6 months should apply for a Student Visit Visa. All applications at all other VACs remain unaffected. This will be a temporary pause while we carry out a thorough investigation. We hope to start accepting applications again as soon as possible.
Applicants who have already submitted applications and have provided biometrics on or before 16th September 2009 will have their applications processed.
Currently, for operational reasons students in the Fujian Province cannot apply for a Tier 4 visa outside of the Fuzhou, Shenzhen and Guangzhou. This process will continue. Only applicants from Fujian who are lawfully resident outside of the Province will be able to submit applications for long term English or NVQ courses at other VACs in China.

How to apply for a visa in Mongolia
Citizens of Mongolia should submit their applications at the Visa Section of the British Embassy in Ulaanbaatar. The British Embassy in Ulaanbaatar accepts visa applications from 09.00 – 11.00 on Monday-Thursday mornings.
Applications for UK visas and passports are forwarded to the British Embassy in Beijing, where the visas are issued. We recommend that visa applicants therefore apply a minimum of 15 working days before they intend to travel.
Since December 2007 we have taken biometrics data in the form of a ten-finger scan and digital photographs of applicants when they apply for visas. Therefore applicants for visas must apply at the Embassy in person.

Can I submit my Visa Application by post?
No. You are required to attend the visa application centre in person to submit your completed visa application form, supporting documents and biometric data (digital fingerscan and photograph). You can make an online application using the online visa application system but you will still be required to attend the visa application centre to submit your biometric data. The UK Border Agency cannot process your visa application until you have submitted your biometric data.

You cannot make an appointment to attend the visa application centre using the online application system as it is currently not operational in China. This website can only be used to complete your visa application form. You should print your completed visa form and take it to the nearest visa application centre where you family book is registered, along with your supporting documents and the appropriate visa application fee. Currently there is no need to make an appointment for your visa application in China. You can attend any visa application centre in China on a first come first served basis.

Do I need to submit original documentation with my application?
You must provide original documents. Failure to submit original documents may mean your visa application is delayed or refused. You should particularly include original documents relating to birth, marriage, divorce and death. If you are not able to include original documents of these then you should send attested copies. You should supply a photocopy of each supporting document you are submitting with your visa application form. Your photocopied documents should be clearly legible, A4 size only unless legal size documents.

Any translated documents need to be submitted with the original document for verification. All translated documents must include the following information:

What is a Property Inspection Report and how can I get one?
You can get a Property Inspection Report from any qualified body independent of the applicant or sponsor. The report should confirm the status of the proposed accommodation, for example the size of the property, who will be living there. If you cannot provide a Property Inspection Report you should provide a written description of the property, stating who else will be living there. A copy of the Council Tax bill in the householder's name should accompany this. If the property is rented, you should provide a copy of the lease agreement and written confirmation from the landlord that there is no objection to your occupancy, as well as any other supporting evidence you feel is appropriate.

Do I need a visa to transit the UK en route to the Republic of Ireland?
Direct Airside Transit Visa (DATV) nationals transiting the UK on their way to the Republic of Ireland must obtain a Visit Visa - not a Visitor in Transit visa, which is only for transit to a destination outside the Common Travel Area (Rules HC395 paragraph 47 refers). If you are staying only for a short period and you do not need to pass immigration control (i.e. a simple transfer to another flight or terminal but remaining airside without passing immigration control) you will require a DATV. If you need to catch a plane from another airport, or need to pass to immigration control before catching your next flight - then you will require a visitor in transit visa.

Information on a Settlement Visa & Indefinite Leave to Remain in the UK
If you have a settlement visa, you will be allowed to stay and work in the UK for two years. Near the end of this time, if you are still married and/or intend to continue living together, you can apply to stay permanently in the UK.
The UK Border Agency will deal with your application to stay permanently in the UK. Before the end of the probationary two years Leave to Enter (LTE) has expired you will need to apply to the UK Border Agency for Indefinite Leave to Remain (ILR) in the UK. When you do this you will be required to pay a non-refundable fee and provide certain documents as specified on the UK Border Agency website:

Duration of Visit Visas
If the application is successful, the Entry Clearance Officer will decide the duration of the Visit Visa. It is at their discretion as to whether or not an applicant can be given a 1, 2, 5 or 10 year Visit Visa.
UK Border Agency policy states that the Entry Clearance Officer must balance their decision on the issuing length of Long Term Visas against local knowledge and circumstances at post, as well as factors such as whether personal circumstances are likely to change significantly during the validity of the visa. Each application in assessed on it's own merits and if an Entry Clearance Officer decides a shorter length visa is more appropriate than the one applied for, they are able to issue the shorter duration. In this situation the UK Border Agency does not make refunds.

Guidance on Child-Minding by family visitors
It is acceptable for general visitors to act as temporary child minders for relatives where:
∙ The visitor is a close relative of the parent (e.g. parent, sibling, in-law). More distant relatives are only acceptable if they have formed part of the family unit or are the closest surviving relatives of the parents;
∙ Neither parent is able to supervise the daytime care of the child;
∙ It is not simply an arrangement to enable both parents to take gainful employment or to study;
∙ Neither parent is in a category leading to settlement;
∙ the visitor will not receive a salary (disregarding provision of board, accommodation and pocket money);
∙ The visitor intends to remain in the United Kingdom for not more than 6 months If it is suspected that the arrangement amounts to employment (paid or unpaid) the application should be refused on those grounds.

How far in advance can my Points Based System (PBS) visa be issued?
For all PBS Tiers 1, 2 & 5, we can only issue your visa up to a maximum of 14 days before the start date of your Certificate of Sponsorship (COS).
For PBS Tier 4 (Students), we can only issue your visa up to a maximum of 1 month before the Certificate of Sponsorship (CAS) start date. However, if you are doing a course that is less than six months and is not a course to prepare you for study (pre-sessional), you will be able to come to the UK up to seven days before the start of the course.

I have been waiting over 3 weeks for my visa, where is it?
Please be advised that we are currently receiving a high volume of applications and as such, all visa applications are taking longer to process than usual. We continue to urge you to submit your visa application as early as possible to ensure the best chance of meeting your intended departure date. We strongly recommend that travellers do not purchase tickets or commit to other travel costs before the visa application has been processed, as there continues to be a risk that your visa application may be delayed or possibly refused.

If your passport has been submitted and you require it back, you will need to withdraw your visa
application by completing a withdrawal form at the visa application centre. This means that your visa application will expire and you will need to apply and pay again when you next apply for a visa. You will not receive a refund.

My education provider's licence is suspended - what can I do?
If your approved education provider's licence is suspended, they cannot issue any new visa letters. If you have already applied for a visa to enter the UK to study with a suspended licence holder, we will hold your application until the suspension is resolved. These applications for entry clearance will not be considered until we have made a final decision on the status of the sponsor. If the licence is withdrawn then we will refuse your visa.
We can not comment on the contract that individual students have with the college with regards to funding. This is between the student and the UK Education Provider.

Can I submit more documents after I have submitted my visa application?
You will not be able to submit further documents after you have submitted your application at the visa application centre. The documents you submit at the time that you make your application are the only documents that can be considered. Documents cannot be sent later by post, fax or email.

Appeals and Administrative Reviews

If I am refused a visa, what can I do now? Can I appeal against the decision?
The decision of the application was based on the information provided at the time of the application. Once a decision has been made we cannot revise or amend the original decision.
Certain categories of visa application, including family visits and settlement, attract full rights of appeal if refused. If you have full rights of appeal this will be stated on your written notice of refusal. Applications for visas to enter the UK in other categories attract limited rights of appeal if refused. If you have limited rights of appeal this will be clearly stated on your written notice of refusal.
If your visa application has been refused and you have a limited right of appeal and you still wish to visit the UK, you will need to make a new application. The reasons for the visa refusal have been explained in the refusal notice and you should address these reasons, should you decide to reapply.

I have a limited right of appeal - what can I do?
If your visa application only has a limited right of appeal and you still wish to visit the UK, you will need to make a new application. The reasons for the visa refusal have been explained in the refusal notice and you should address these reasons, should you decide to reapply.

Appeal (sent to IAFT) process time
The Visa Section and Entry Clearance Officer has no control over when an appeal is heard in the UK as it depends on a number of factors. This can include the type of case and whether you have asked for the case to be heard orally or not. The appeal process can and usually takes between 3 to 6 months and can be longer than this, if you have applied to settle in the UK.

My appeal has been allowed by the Immigration Judge, what do I do now?
If your appeal is allowed, the determination will be sent to the relevant visa section, who will in turn contact you. It can take up to six weeks for allowed determinations to reach visa sections, although in the majority of cases it will be significantly less.
If 6 weeks have passed and the visa section has not contacted you, please let us know and provide the following information:

I've been issued a student visa but now I would like to go to another college/university, can I use my existing visa?
If you already have a student visa but you wish to go to a different college or university, you must apply for a new visa. The visa that was issued in your passport is only valid for the college or university that you originally applied for.

I have a valid UK visa but now wish to travel to the UK for another purpose. Can I use the same visa if it is still valid?
No. If you have a valid UK visa but you wish to go to the UK for another purpose, you must apply for a new visa in the relevant category. The visa issued in your passport is only valid for the travel purpose that you stated on your original application.

Can I travel to the UK if my valid visa is in my old passport / My old passport has expired but my UK visa is still valid - what do I need to do?
Your UK visa remains valid when your passport expires. As well as your new passport, you must also show your old invalid passport with valid visa in it, when you enter the UK. However, if you wish to transfer it into your new passport you will need to submit an application on form VAF1A (see http://www.ukvisas.gov.uk/en/howtoapply/vafs/) to transfer the visa. From 1st April 2009 there is a fee for this service (please check our visa fees page http://www.vfs-uk-cn.com/visafees.aspx for fee updates). The Immigration Regulations 2006 enables the British Embassy to require a person who applies for entry clearance to provide a record of his fingerprints and a photograph of his/her face as part of the application.
