船舶载运危险货物的适装许可

一、执法依据

（一）《中华人民共和国港口法》第三十四条第二款

（二）《中华人民共和国内河交通安全管理条例》第三十二条

（三）《危险化学品安全管理条例》第四十条第三款、四十一条、四十二条

（四）《中华人民共和国船舶载运危险货物安全监督管理规定》

（五）《国际海运危险货物规则》

（六）《国际散装运输危险化学品船舶构造和设备规则》

（七）《国际散装运输液化气体船舶构造与设备规则》

（八）《经1978年议定书修订的1973年国际防止船舶造成污染公约》

（九）《中华人民共和国海事行政许可条件规定》第二十一条

二、受理机构与岗位

海事处受理人员负责船舶载运危险货物适装许可申请的受理。

三、申请材料

（一）承运人或其代理人提交的材料：

1．船舶载运危险货物/污染危害性货物申报单（一式三份）；

2．船舶适装证书及其复印件；

3．（国际）防止油污证书及其复印件（适用时）；

4．定期申报还应提交定期申报申请、证明在固定航线上运输固定危险货物的有关资料；

5．载运危险货物的船舶在运输途中发生过意外情况的，应当在《船舶装载危险货物/污染危害性货物申报单》备注栏内扼要注明所发生的意外情况的原因，已采取的控制措施和目前状况等实际情况，并于抵港后送交详细报告；

6．载运2000吨以上散装持久性货油的国际航行船舶的《油污损害民事责任保险或其他财务保证证书》或1000总吨以上的国际航行船舶和沿海运输船舶的《燃油污染损害民事责任保险或其他财务保证证书》及其复印件；

7．列明实际装载情况的清单或舱单或积载图；

8．拟进行危险货物装卸作业的港口、码头、泊位，具备相应资质，并且符合安全、防污染及保安要求的证明材料；

9．委托证明及委托人和被委托人身份证明及其复印件（委托时）。

(二)货物所有人或其代理人或通过承运人及其代理人提交的材料：

1．危险货物/污染危害性货物安全适运申报单；

2．对于易燃、易爆、易腐蚀、剧毒、感染性、污染危害性等危险品，附具相应的危险货物安全技术说明书、安全作业注意事项、人员防护；应急急救和泄漏处置措施等资料；

3．装运下列危险货物出港提供的资料：

●使用集装箱装运危险货物的，需提供集装箱装箱检查员签名确认的《集装箱装箱证明书》；

●装载包装危险货物的，需提供包装或中型散装容器检验合格证明书或压力容器检验合格证明书；

●使用可移动罐柜装运危险货物的，应提交罐柜检验合格证明书；

●装载放射性物品的，应提交放射性剂量证明；

●货物需要添加抑制剂或者稳定剂的，应提交添加的抑制剂或稳定剂的名称、数量、温度要求、有效期及超过有效期时应采取的措施；

●装运限量危险货物的，应提交事先经海事管理机构确认的《限量内危险货物证明书》；

●托运《水路危险货物运输规则》和《国际危规》中未列明的危险货物，应提交海事管理机构认可的机构出具的“危险货物鉴定表”；

●托运MARPOL73/78公约附则II中未列名的或新的散装液体化学品，应提交海事管理机构认可的机构出具的分类评估意见；

●按规定可按非危险货物出运的危险货物需提供相应的免除证书或证明；

●装运可免除量危险货物的，应提交事先经海事管理机构确认的《可免除量内危险货物证明书》。

4．按规定尚需国家有关主管部门或进出口国家的主管机关同意后方能载运进、出口的

货物，应持有办理完有关手续的证明。

5．委托证明及委托人和被委托人身份证明及其复印件（委托时）。

四、办结时限

自受理之日起1个工作日内办结，定期申报的3个工作日内办结。
