服务指南

一、 人员范围

高层次人才和投资者指下列人员：

1、 省（部）级国家机关邀（聘）请的高级顾问以及执行中央或者地方与外国签署的国家级和省（部）级科技合作项目、重点工程协议、人才交流项目的高科技、高层次管理人员；

2、 对国家及社会等有重大或者突出贡献的人员以及执行政府间无偿援助协议的人员；

3、 国家和省（部）级科研机构、重点高等院校聘用的学术、科研带头人以及有关单位聘用的具有副教授、副研究员以上职称或者享受同等待遇的学术、科研骨干；

4、 在企业、事业单位中担任副总经理以上职务或者享受同等待遇的高级管理人员和重要专业技术人员；

5、 在穗投资300万美元以上的人员以及符合上述条件的外国企业或者其他经济组织派遣来中国的管理人员和专业技术人员；

6、 国际重要科学奖项的外国籍华人获得者和其他杰出、重要外国籍华人；

7、 第1项至第6项人员的配偶和不满18周岁的子女。

二、 居留许可申请

高层次人才和投资者及随行家属（配偶和未满18周岁的子女），应持Z签证入境，入境后30日之内到市公安局出入境管理处申请居留许可。

申请居留许可时，须回答有关询问并提供下列材料：

1、本人有效护照及签证的原件和复印件；

2、如实填写《外国人签证、居留许可申请表》，并粘贴一张近期二寸半身正面免冠照片；

3、居住地公安派出所出具的《境外人员临时住宿登记表》（住宾馆、酒店者除外）；

4、高层次人才申请居留许可须提供一类被授权单位公函以及《外国专家证》或者《外国人就业证》等证明文件；投资者申请居留许可时须提供外商投资企业批准证书、营业执照等证明文件；

5、任职或所投资单位出具的单位公函；

6、广东出入境检验检疫局出具的《健康证明》原件（在穗居留1年以上且年满18周岁者提交）；

7、随行家属还需提供任职或者投资单位公函，配偶还需提供婚姻证明，子女还需提供亲属关系证明。

三、 签证申请

高层次人才申请F签证须提供一类授权单位公函等有关证明文件；投资者申请F签证须提供外商投资企业批准证书、营业执照等有关证明文件。

四、注意事项

1、居留许可项目内容变更（如居留事由、护照号码、住址、就职单位、偕行人等情况），持证人须在10日内到市公安局出入境管理处办理变更手续；

2、居留许可迁移，持证人须在10日内到迁出地或迁入地的公安出入境管理部门办理迁移手续；

3、因故终止在穗学习或工作的外国人，应及时缴销外国人居留许可，并办理相应签证；

4、持有居留许可的外国人，可以在居留许可有效期内在华居留，也可以多次出入中国国境；

5、 申请居留许可，可以由工作单位代办，但首次申请居留许可，必须由本人申请；

6、对在中国非法居（停）留或具有其它违法行为的外国人或责任人，公安机关将依法予以处罚；

7、外国人申请签证、居留许可，必须按照中国政府主管部门的有关规定缴纳费用；

8、上述可以申请签证、居留许可的有效期及签证的入境次数，应以公安机关出入境管理部门最终批准的结果为准；

9、公安机关出入境管理部门有权依法拒发外国人签证、证件，对已发出的签证、证件有权吊销或宣布作废，受理、审批、签发签证、证件需5个工作日。

Instructions of Application for Visa and Residence Permit

(For High-Level Personnel and Investors)

I. Eligibility

High-level personnel and investors refer to the following:

1.Senior consultants invited (or employed) by government offices at the province-level or ministry-level, as well as those high-tech and high-level managerial personnel serving the cooperative technology projects, key project agreements or talent exchange projects at the state-level, province-level or ministry-level signed by central or local governments and foreign countries;

2. Those who have made important or outstanding contributions to the country and society, as well as those who are carrying out gratis aid agreements between governments;

3. Leaders of academic or scientific research employed by scientific research institutes at the state-level, province-level or ministry-level or key institutions of higher education, as well as key scholars or researchers with professional titles no lower than associate professors, associate researchers, or enjoying equal favorable treatment employed by relevant institutions;

4. Senior managers and important professionals who hold posts as or enjoy equal favorable treatment with deputy general managers or higher positions in enterprises or institutions;

5. Those who have made an investment of three million U.S. dollars or more in Guangzhou, as well as managers and professionals dispatched to China by foreign enterprises and other economic organizations which have completed such investment;

6. Chinese with foreign nationality who have been awarded important international prizes in science, as well as other outstanding or important Chinese with foreign nationality;

7. Spouses and children (under age 18) of those mentioned from item 1 to item 6.

II. Application for Residence Permit

High-level personnel, investors, as well as your accompanying family members (spouses and children under age 18), shall enter China with Z Visas, and shall, within 30 days of entry, apply for Residence Permits from the Division of Exit and Entry Administration of Guangzhou Municipal Public Security Bureau.

In applying for residence permits, you are obligated to answer relevant inquiries and submit

the following documents:

1. The original and photocopy of your valid passport and Chinese visa;

2. A form of Application for Chinese Visa or Residence Permit which you have filled correctly and one of your recent passport-size 2 inch photos (full face without hat);

3. A Registration Form of Temporary Accommodation for Aliens issued by local street police station (excluding those lodging at guesthouse or hotel);

4. An official letters from the authorized institution of Class A and your “Foreigner’s Employment Permit” or “Foreign Expert Certificate” if you are high-level personnel. The approval certificate of foreign-invested enterprise and its business licenses if you are an investor;

5. An official letters from your employer or the organization making investment;

6. Your Health Certificate issued by Guangdong Exit-Entry Inspection and Quarantine Bureau (for applicants aged 18 or above and those who will stay in Guangzhou for one year or above);

7. In addition, your accompanying family members shall submit an official letter of confirmation from your employer or the organization making investment. Your spouse shall submit your marriage certificate. Your parents or children shall submit kinship certificates.

III. Application for Visas

In applying for visa F, the high-level personnel are required to provide official letters from authorized institutions of Class A, while the investors are required to provide the approval certificate of foreign-invested enterprises and its business licenses.

IV. Notices

1. In case of content change of the Alien Residence Permit (such as purpose of residence, passport number, address, employer and accompanying children), the holder may apply for replacement, within 10 days of such changes, to the Entry-Exit Administration Division of Guangzhou Public Security Bureau;

2. Holders of Alien Residence Permit who wish to move out of the city of current residence, shall, register such move to the local entry-exit administration division of public security bureau within 10 days either before moving or after arrival at the new destination;

3. Aliens who terminate their study or work in Guangzhou shall promptly hand in your residence permits for cancellation and apply for corresponding visas;

4. Holders of Alien residence permits can reside in China within the validity period of residence permits, and can make multiple entries into China;

5. To apply for residence permits, all formalities can be submitted by your employer on your behalf, excluding application for the first time, which should be submitted by the applicants themselves;

6.Penalties shall impose on aliens who illegally stay in China or in violation of other Chinese laws or on persons responsible for such violations by the public security organs in accordance with the law;

7.Aliens applying for visas and residence permits shall pay visa and certificate fees to the prescribed rates set by competent authorities of the Chinese Government;

8.The validity period of visas and its number of entries or residence permits shall be taken as the final decision by Division of Exit and Entry Administration of Public Security organs;

9. The Division of Exit and Entry Administration of Public Security organ has the power to refuse to issue visas and certificates or to cancel or annul visas and certificates already issued. Handling, examining applications and issuing visas and certificates will need five working days.
